Your franchise will be for a location that Sbarro will need to approve or, in the case of a Conversion Restaurant, for an existing location that Sbarro and you will mutually designate. When approving a site, we consider, among other things, pedestrian traffic and the presence of competitors. Sbarro’s recommendation or approval of any site does not imply, guaranty, assure, warrant, or predict profitability or success, express or implied. You will not receive an exclusive territory.

Pre-Opening Obligations Before you open your franchised business, Sbarro or its designee will: (1) Provide you with assistance in the site evaluation and selection process once you have located a particular site for a new Restaurant; or, in the case of a Conversion Restaurant, review locations as to which leases have already been signed by Sbarro or its Affiliate (Franchise Agreement, Section 4). Sbarro does not generally own the premises of Restaurants.
